Appellant Ellis Thomas was convicted after a jury trial on three counts of sale of narcotics and was sentenced on November 27, 1972, to a period of imprisonment of 10 years on each count, with the sentences on Counts I and II to be served consecutively and the sentence on Count III to be served concurrently. The superior court ordered that Thomas was not to be eligible for parole until he had served one-third of each of the two consecutive sentences. After a jury trial, Thomas was also convicted of assault with a dangerous weapon and was sentenced on November 27, 1972, to a period of imprisonment of 10 years, to run concurrently with the narcotics sentences. The effect of the sentences was that Thomas was ordered to serve a total of 20 years in prison, without eligibility for parole until he had served six and two-thirds years.
