Nicholson appeals from his conviction for first degree murder. The trial in the superior court was bifurcated. The first part was a trial by jury in which Nicholson was found guilty of first degree murder in the homicide of Tom Dillon, chief of police in Bethel. The second part was an evidentiary hearing by the court, without a jury, in which the court determined that Nicholson was criminally responsible for his acts.
