Fess v. Parke

Defendants, Lois and Steven Johnson, appeal from an order granting in part a petition filed by George Bauer and Wendell Johnson, executors of Edmund Johnsons estate, and a motion for summary judgment filed individually by Wendell Johnson. At issue is the construction of a partnership agreement. Wendell Johnson cross-appeals, alleging the trial court erred in refusing to strike an untimely filed jury demand.
