Feykert v. Hardy

In this equity suit plaintiff seeks to establish that certain real property constituting the home of herself and her deceased husband, Mort D. Goldberg, was joint tenancy property which passed automatically to her upon his death; that certain other real and personal property (the major portion of the estate) was community property in which she owned a one-half interest regardless of the last will of her husband; also that the final probate decree which distributed all of said properties to three trustees be set aside upon the ground that it had been obtained by extrinsic fraud. The court sustained without leave to amend a general demurrer to each count of her amended complaint.
