George King brought this suit against Jack Moberley, Sheriff of Shackelford County, and Dave Reeves, Sheriff of Jones County. King alleged that the defendants falsely accused him of having committed felony theft, and that they without permission searched his pickup and premises for stolen property. He sought actual damages in the sum of $5,000 and an additional $5,000 exemplary damages. The case was tried before a jury and upon conclusion of the testimony defendant Jack Moberleys motion for an instructed verdict was granted. In answer to special issues bearing on the question of the liability of the defendant Dave Reeves, the jury found that the officers did not search plaintiffs premises and pickup without his permission. Judgment was rendered that the plaintiff King take nothing and he has brought this appeal.
