Publisher Description

This is an appeal from the district courts denial of a motion for summary judgment for claims brought against police officers John Mataya and Greg Connolly under 42 U.S.C. § 1983, for false arrest and use of excessive force. Mataya and Connolly moved for summary judgment on two grounds: (1) they are entitled to qualified immunity; and (2) they had probable cause to arrest plaintiff, thereby barring a suit for false arrest. The district court determined that genuine issues of material fact existed and denied the motion. We affirm.
