Kailin V. Armstrong

¶1. This appeal arises out of a commercial real estate transaction in which Stephen and Linda Kailin purchased the property known as the Monona Center from Perry Armstrong. The Kailins appeal the summary judgment in favor of Armstrong, First Weber Group, Inc., and salesperson Robert Carpenter, which dismissed the Kailins' claims for breach of contract, intentional misrepresentation, and violation of Wis. Stat. § 100.18 (1999-2000).*fn1 The complaint alleged the defendants failed to disclose that one of the tenants had a history of delinquency in rent payments and was in default both at the time the offer to purchase was accepted and at the time of closing.
