Kelley v. Metropolitan County Board of Education of Nashville and Davidson County

This much delayed school desegregation case is before this court for review of a desegregation plan approved by the District Court. It offers no new legal issues and can and must be decided by this court on the basis of final decisions of the United States Supreme Court. Milliken v. Bradley, 433 U.S. 267, 53 L. Ed. 2d 745, 97 S. Ct. 2749 (1977) (Milliken II) requires our affirmance of the District Court on several issues. The cases that require our reversal of two issues decided by the lower court are legion. Metropolitan Board of Education, 463 F.2d 732 (6th Cir.), cert. denied, 409 U.S. 1001, 34 L. Ed. 2d 262, 93 S. Ct. 322 (1972).
