The appellant, Gerald Lee Day, was convicted by a jury, Judge Ralph W. Powers presiding, in the Circuit Court for Prince Georges County on July 13, 1966, for the crimes of murder in the first degree and assault with intent to maim. He was sentenced to life imprisonment in the Maryland Penitentiary for the murder of Charles Dennis Shelley, and ten years in the Maryland Penitentiary for assault with intent to maim Charles Parker, to run concurrently with the prior sentence.
