This action arose out of an automobile collision at the right-angle intersection of Third and Mifflin streets in the city of Madison on September 18, 1964. Mrs. Helen Sailing, the plaintiff, was driving west on Mifflin street and was confronted by a yield sign just before the Third street intersection. Defendant John Wallestad was traveling north on Third street with no traffic control sign as he approached Mifflin street. A light rain was falling at the time of the collision, about 7:40 a. m. The front of Mrs. Sailings auto struck the right front fender of the Wallestad auto at a location in the northeast quadrant of the intersection. After the initial impact the cars came together so as to damage the left rear side of the Sailing vehicle and the right rear side of Wallestads car. Mrs. Sailings car came to rest in Third street just north of the point of impact. The Wallestad auto continued across Third street and struck a tree near the northeast corner of the intersection.
