1 Appellant, Dow Leroy Seher, hereinafter referred to as defendant, was charged, tried and convicted for the offense of Unlawful Possession of Marijuana with Intent to Distribute, in the District Court of Pottawatomie County, Case No. CRF-74-372. After both parties waived their right to trial by jury, the defendant was tried by the Court on the 2nd day of April 1975. Subsequently, on the 19th day of September 1975, a verdict of guilty was returned by the Court and the defendant was sentenced to serve a term of two (2) years in the State Penitentiary and to pay a fine of Five Hundred Dollars ($500.00) and cost of the prosecution, one of the years of the sentence was suspended. From said judgment and sentence, the defendant has filed this timely appeal.
