Ella Mae Murphy and Another v. Joseph H‪.‬

Two actions in the Stearns County District Court arising out of a collision between two automobiles driven by Elmer Miller and Phyllis Murphy allegedly caused by the conduct of defendant Joseph H. Hennen, d.b.a. The Middle Bar, in furnishing intoxicating liquor to said Elmer Miller. The first action was brought by Ella Mae Murphy to recover for the death of said Phyllis Murphy, and the second action was brought by Elizabeth Philippi for personal injuries which she sustained as a passenger in the Murphy automobile. The cases were tried together before E. J. Ruegemer, Judge, and a jury, which returned verdicts for plaintiffs for $9,000 and $12,300 respectively against defendant Hennen, the actions having been dismissed as to another defendant. Defendant Hennen appealed from an order denying his alternative motion for judgments notwithstanding the verdicts or for a new trial.
