1 In 2001, a jury convicted Brian Jeffrey Dann of three counts of first degree murder and one count of first degree burglary. The trial judge imposed death sentences for each murder after finding one aggravating circumstance beyond a reasonable doubt. See Ariz. Rev. Stat. (A.R.S.) § 13-751.F.8 (Supp. 2008).The judge concluded that the mitigating circumstances were not "sufficiently substantial to call for leniency" and sentenced Dann to death. See § 13-751.E.
