LETTS, J. By way of a counterclaim, a tenant seeks to avoid the consequences of breaching a lease, alleging that the landlord fraudulently
misrepresented that there was sufficient parking available to enable the tenant to gain governmental approval to operate a
sit-down restaurant. From the trial court's grant of the motion for summary judgment in favor of the landlord, the tenant
now appeals. We affirm.
