1. Equity ? Supreme Court may make findings. In equity cases the Supreme Court has the right to make independent findings of fact after a review of all the evidence. 2. Appeal and error ? Substantial evidence rule. Where there is substantial evidence supporting the trial court the Supreme Court will not interfere. 3. Appeal and error ? Equal division of Justices causes affirmance. Where appeal from decree entered in suit in equity to quiet title to realty was heard by four members of Supreme Court, one justice deeming himself disqualified to sit, and the remaining justices were equally divided on powers and duties of the Court on Appeals in equity, decree of the District Court stood affirmed.
