Sanders v. Sullivan

LUMBARD, Circuit Judge: The State of New York appeals the order of the District Court for the Southern District of New York, Constance Baker Motley, Judge, granting the petition of Walter Sanders for a writ of habeas corpus. Having traveled a lengthy procedural route, Sanders's habeas petition comes before us again following our remand. See Sanders v. Sullivan, 863 F.2d 218 (2d Cir. 1988) (Sanders I).
