Citation is disfavored, but may be permitted in accordance with the provisions of Rule 30(e)(3) of the North Carolina Rules of Appellate Procedure. In July 2005, defendant filled out a sworn affidavit of indigency for charges otherwise unrelated to the instant case. Defendant put a zero in all columns on the affidavit, including ""assets"" and ""liabilities"" in real estate. Defendant swore under oath that his statements on the form were true to the best of his knowledge, even after being informed that false or dishonest answers concerning his financial status could lead to prosecution for perjury. A subsequent title search revealed that defendant was the record owner of a parcel of real property and tax records showed that defendant paid taxes on the property and entered into a payment plan for other taxes on it. On 3 May 2007, a jury unanimously found defendant guilty of perjury. The trial court then sentenced defendant to 107 months' to 138 months' imprisonment. Defendant now appeals.
