Appeal by plaintiffs, the named beneficiary of a life insurance policy and the decedent's employer, from trial court's dismissal of their claim against defendant insurance agent/broker after plaintiffs had settled with the insurer. Since a fact question existed as to whether the defendant was acting as a broker and therefore independently liable, the trial court erred in dismissing the plaintiffs' claim. SHERAN, Chief Justice.
