Plaintiff in error, operator of a grocery supermarket, was the defendant in the trial court in an action in which the plaintiff obtained a personal injury judgment in the amount of $10,000. The action grew out of plaintiffs falling on some ice in a parking lot which was maintained by the defendant adjacent to its store for the use of customers. The plaintiff suffered a broken hip which necessitated an internal reduction operation. Defendant claims that the evidence was insufficient and that plaintiff was guilty of contributory negligence as a matter of law. On these grounds it seeks reversal of the judgment.
