Kmiec And Wife v. Town Spider Lake

The plaintiffs-respondents, John S. Kmiec and Mildred Kmiec (hereinafter plaintiffs), commenced an action for declaratory judgment challenging the constitutionality of the zoning ordinances of both Sawyer county and the town of Spider Lake in Sawyer county insofar as they placed the particular real estate owned by the plaintiffs in an A-1, agricultural zoning district. Judgment was entered declaring both ordinances unconstitutional and void as applied to the real estate owned by the plaintiffs. The town of Spider Lake, defendant-appellant (hereinafter defendant) has appealed from the judgment.
