TOOZE, Justice. This is an action to recover damages for the death of Rudolph Quetschke, plaintiffs intestate, resulting from the alleged negligent operation of a motor logging truck and trailer by the defendants Fedell Peterson and M. Zeller. The case was tried to a jury, resulting in a verdict and judgment in favor of plaintiff in the sum of $9,000. Upon defendants motion, the verdict and judgment were set aside, and judgment notwithstanding the verdict and dismissing the action was entered in favor of defendants. Plaintiff appeals.
