The plaintiff in error Ronald H. Ramer (defendant hereinafter) was charged with indecent behavior with a child in violation of sec. 944.11 (1), Stats. The defendant, aged twenty-seven years, and his friend Charles Newman on December 3, 1966, after obtaining some beer went to the home of the parents of Shirley Stoll near Alma, Wisconsin. At that time she was baby-sitting for three children, a boy nine years, a girl six years, and a baby three years. During the stay the defendant took indecent liberties with the six-year-old girl. During the trial both the boy and the girl testified after first being questioned on competency in the presence of a jury.
