Action commenced October 28, 1953 by plaintiff Edna Waddell against defendant Hasson Mamat for damages arising out of personal
injuries sustained on November 13, 1951 in a collision between the automobile of the defendant and the automobile of Robert
Andrews, in which she was a passenger. Defendant sought to implead Robert Andrews, a nonresident. One copy of the order to
show cause dated June 16, 1954 together with a proposed cross-complaint of the defendant against Andrews was delivered to
the commissioner of motor vehicles of Wisconsin for substituted service and another copy was forwarded to Andrews at 3555
Dempster street, Skokie, Illinois. Hearing was held and an order was entered on July 7, 1954 granting the requested impleader
and allowing the proposed cross-complaint to stand. Copies of said order together with an amended summons and complaint were
forwarded to the commissioner of motor vehicles and also to Andrews at the Skokie address. No appearance was ever made by
Andrews. On November 17, 1954 a special appearance was made in his behalf by Quarles, Spence & Quarles of Milwaukee,
who moved to quash service on Andrews for lack of jurisdiction. From an order granting the motion and quashing the service,
plaintiff and defendant appeal. Further facts will be stated in the opinion.
