The principal issue in this case is whether Alaskas two-year tort statute of limitations or three-year statute of limitations for actions against peace officers applies to Jenkins suit against three Anchorage police officers. Although inartfully plead, Jenkins complaint can be read to state three separate theories for relief. These are abuse of process, false arrest (imprisonment) and a violation of civil rights under 42 U.S.C. § 1983. The superior court dismissed Jenkins complaint without opinion, apparently on the ground that his suit was barred by the two-year tort statute of limitations. We affirm in part and reverse in part.
