Edwards v. Superior Court of Santa Clara County

In this case we decide, among other issues, whether the plaintiff in a personal injury action may insist upon the presence of his counsel at an examination conducted by defendants psychiatrist. We conclude that such a psychiatric examination should occur in the presence of the examiner and the examinee alone.
