The plaintiff, Daniel Edwards, seeks to compel the Department of Justice to produce certain ""Nightstalker""1 surveillance reports allegedly compiled when the Illinois State Police and the FBI were investigating Edwards. Edwards argues the information is vital to his state post-conviction hearing. The district court granted the Department's motion to dismiss the state court show cause order proceeding and to quash the state court subpoenas because the state court did not have jurisdiction to enforce the subpoenas. The district court held the demand for the exempted federal material was contrary to valid agency regulations. Edwards appeals. I.
