Ellis v. Race

1 The named plaintiffs filed this joint action on March 26, 1962, seeking damages for their personal injuries incurred in a common accident, alleged to have resulted from various acts and omissions by defendant and which were asserted to have been the proximate cause thereof. The matters which provide the basis for the issue herein appealed disclosed by the pleadings and evidence are summarized hereafter.
