Publisher Description
Appellant Department of Social and Health Services (DSHS) placed respondent Alan Fettigs name on the central registry of child abuse and revoked his day-care license. The DSHS decision was upheld by an administrative law judge, and Fettig requested judicial review. DSHS appeals from a decision of the superior court reversing and remanding the case for further administrative proceedings. DSHS raises issues involving the admissibility of hearsay evidence and expert testimony and the striking of a condition for Fettigs retention of his day-care license. The Fettigs cross-appeal, requesting this court to affirm the reversal, but to strike the order to remand. We reverse the trial court on all issues except one, thereby upholding the decision of the administrative law judge.
