Action commenced April 5, 1947, by Fidelity Savings Bank, as administrator of the estate of John Rodowca, deceased, plaintiff, against Frank Aulik and Travelers Insurance Company, a foreign corporation, defendants and appellants, to recover on a death claim which resulted from the collision of two automobiles. Aulik and his insurance carrier impleaded John S. Rodowca and State Farm Mutual Automobile Insurance Company, insurance carrier, seeking contribution in a cross complaint. Impleaded defendants answered the cross complaint and later moved for summary judgment. From a summary judgment dismissing the cross complaint of defendants against the impleaded defendants for contribution, defendants appeal. The material facts will be stated in the opinion.
