[T][U] Integrated Computer Systems Publishing Co. V. Learning Tree Open University

Learning Tree Open University ("LTU") appeals from the district courts Judgment of Dismissal in favor of Integrated Computer Systems Publishing ("ICSP") upon remand from the Ninth Circuit in LTUs action to have ICSP held in contempt of a 1987 Consent Judgment for changing its tradename to "Learning Tree International." LTU also appeals the district courts award of attorneys fees and costs to ICSP. Because the record is unclear regarding whether the district court and the parties understood the jurisdiction of the district court upon remand, we vacate the Judgment of Dismissal and remand. We also vacate and remand the district courts award of attorneys fees and costs for the district court action, but we affirm the award of appellate attorneys fees and costs for the previous appeal.
