Publisher Description

Calvin Q. Yarborough was indicted on charges of aggravated assault in connection with the beating and stabbing of his mother-in-law. A Harrison County jury returned a guilty verdict and assessed punishment at thirteen years imprisonment. The trial court imposed sentence in accordance with the jurys verdict. Yarborough appeals, contending the trial court erred by admitting his videotaped statement and by denying his motion for directed verdict. He also contends the jurys rejection of his assertion of self-defense is against the great weight and preponderance of the evidence. Because we conclude that his statement was not a product of custodial interrogation and that the evidence is legally and factually sufficient to support the jurys verdict, we affirm the judgment.
