Plaintiff-appellee AAMCO Transmissions, Inc. (AAMCO), brought an action against defendant-appellant Charles Martin to enforce a settlement reached in litigation previously pending before then District Judge Cornelia Kennedy. The previous litigation involved a complaint by Martin against AAMCO, claiming that AAMCO breached their franchise agreement by providing an unsuitable location for Martins transmission center. AAMCO counterclaimed on the basis of Martins failure to pay franchise fees and advertising contributions. On the date the trial was to have begun, the parties entered into a stipulation of discontinuance and settlement. The settlement was made a part of the record at that time.
