Two actions in the district court for Mower county, consolidated for trial and heard together on appeal, one by Mrs. T. B. Hatley to recover for injuries sustained in a collision between her husbands car, which she was driving, and a truck owned by defendant Rochester Dairy Co-operative and driven by the defendant Marvin A. Berg, which collision is alleged to have been caused by the negligence of defendant Paul Klingsheim in the operation of his auto; and the other action by her husband to recover consequential damages and for damage to his car. The cases were tried before Martin A. Nelson, Judge, and a jury, which returned a verdict for defendants in Mrs. Hatleys case and one of $808.50 for Mr. Hatley against defendant Paul Klingsheim and in favor of the other defendants. Plaintiffs moved for a new trial and appealed from the orders denying their motions, the court having granted the motion in Mr. Hatleys case unless defendant Klingsheim should consent to an increase of the verdict to $1,400, which said defendant refused to do.
