The opinion of the court was delivered by This action was commenced pursuant to G.S. 1949, 44-512a to recover a lump-sum judgment for all past due and unpaid, and future installment payments of a workmen's compensation award. Judgment was in favor of the workman-plaintiff, and the employer-defendant has appealed. On October 28, 1960, the workmen's compensation commissioner entered an award of compensation in favor of plaintiff in the total sum of $15,654.31 plus all medical expense not to exceed $2,500. On December 12, 1960, plaintiff served a written demand upon defendant pursuant to G.S. 1949, 44-512a to pay all amounts due and owing to him under the compensation award, and further, that should defendant fail to pay such amounts within two weeks, suit would be brought for the entire amount of compensation awarded. Defendant failed to comply with the statutory demand, and plaintiff commenced this action.
