1 The appellant, Charles Elsworth Zackery, hereinafter referred to as defendant, was convicted, upon trial by jury, in the District Court, Oklahoma County, Case No. CRF-76-1697, for the offense of Assault and Battery with a Dangerous Weapon, After Former Conviction of a Felony, in violation of 21 O.S. 1971 ? 645 [21-645]. The jury fixed his punishment at a term of two (2) years in the custody of the Department of Corrections and on October 1, 1976, the defendant was sentenced in accordance with the jurys verdict. From said judgment and sentence the defendant has filed this timely appeal.
