Frank Paul Cillo appeals his judgments for committing a lewd, lascivious or indecent act on a child less than sixteen years of age. He argues that the trial court erred in denying the motion to suppress his confession because the confession was obtained in violation of his Miranda *fn1 rights. The trial court denied the motion, finding that Mr. Cillo was not in custody when the statements were made and that the statements were voluntary. We affirm.
