I found the article "A Higher and Better Definition" (Winter 2004) interesting and thought provoking, but I also found myself questioning some of the points made and conclusions reached. I have been working with the current definition of highest and best use for more years than I can remember and have not found the definition to be either ambiguous or redundant. The identity of the conjunction "and" instead of "or" as a problem in the definition appears to me to be a misplaced concern requiring a rather narrow interpretation of the sentence.
