Publisher Description

An earlier version of this article was delivered as the incoming president's address at the 2002 annual conference of the American Society for Bioethics and the Humanities. One of my favorite books about doctors is John Berger's A Fortunate Man. (1) Toward the end of that book, Berger asks a question about the way we evaluate doctors' work. He writes, "Supposing one is an intelligent but careless doctor--how much must he forfeit for treating one case, ten cases, a hundred cases carelessly? Supposing that he is an intelligent and unusually dedicated doctor .... What would his bonus be?"

Rethinking the Ethics of Vital Organ Donations: Accepted Medical Practice Already Violates the Dead Donor Rule. Explicitly Jettisoning the Rule--Allowing Vital Organs to Be Extracted, Under Certain Conditions, From Living Patients--Is a Radical Change Only at the Conceptual Level. But It Would Expand the Pools of Eligible Organ Donors. Rethinking the Ethics of Vital Organ Donations: Accepted Medical Practice Already Violates the Dead Donor Rule. Clinical Ethics Consulting and Conflict of Interest: Structurally Intertwined: Clinical Ethical Consultants are Subject to an Unavoidable Conflict of Interest. Their Work Requires That They be Independent, But Incentives Attached to Their Role Chip Relentlessly at Independence. This is a Problem Without Any Solution, But It can at Least be Ameliorated Through Careful Management. Are Alcoholics Less Deserving of Liver Transplants? when Does Behavior Trigger a Lesser Claim to Medical Resources? when Does Chronic Drinking, For Example, Mean That One has a Lesser Claim to a Liver Transplant? Only when One's Behavior Becomes a Callous Indifference to Others' Needs--when One Knows the Consequences of Heavy Drinking and Knows That by Drinking One May End up Depriving Someone else of a Liver.
