Action by plaintiff Ferdinand Klein to recover damages for personal injuries and damage to his automobile against defendants
Edward J. McCarthy and State Farm Mutual Insurance Company, insurer of the McCarthy automobile. On August 20, 1958, at about 3 a. m., a collision occurred between cars driven by plaintiff and McCarthy at an intersection
in the city of Milwaukee. Plaintiff was driving north and McCarthy west. Traffic movement at the intersection is controlled
by traffic lights. The evidence is in sharp conflict as to which deriver had the green light. The jury returned a special
verdict in which it: (1) found both McCarthy and plaintiff causally negligent; (2) apportioned 90 percent of such negligence
to McCarthy and 10 percent to plaintiff; and (3) fixed plaintiff's damages for personal injuries at $12,000. The trial court
answered three other subdivisions of the damage question so as to determine that plaintiff's damages to his car were $250,
his medical expense was $628.35, and his loss of earnings was $1,684.76.
