TYSON, JUDGE James Michael Robinett was indicted for sodomy in the first degree in violation of § 13A-6-63(a)(3), Code of Alabama 1975. The jury found Robinett guilty as charged in the indictment and, following a sentencing hearing, the trial Judge fixed punishment at 25 years' imprisonment in the penitentiary.
