Wray v. State Fund

Brian Wray appeals from the Findings of Fact, Conclusions of Law, and Judgment entered by the Workers Compensation Court which determined that no agreement existed between himself and the State Compensation Mutual Insurance Fund regarding recoupment of lump sum advances and, as a result, that recoupment from his current workers compensation disability benefits is appropriate. We - Page 221 conclude that the parties agreed to recoupment only from Wrays future permanent partial disability benefits and, therefore, reverse the Workers Compensation Court.
