Publisher Description

COFFIN, Senior Circuit Judge A local Teamsters union and two of its members sought to intervene in a class action lawsuit brought by United Parcel Service employees against the trustees of the New England Teamsters and Trucking Industry Pension Fund (""the Fund""). The district court left open the possibility of intervention at the remedial stage of the case -- if one is required -- but denied intervention for the liability proceedings on two grounds: appellants' motion was untimely and their interests were adequately represented by the existing parties. We find no abuse of discretion in the decision to deny intervention, and therefore affirm. I.
