1 Floyd Austin Catron, hereinafter referred to as the defendant was convicted in the Municipal Court of Ponca City, Oklahoma, for violation of a city ordinance, towit: driving a motor vehicle while under the influence of intoxicating liquor. He appealed his case to the county court and was there tried before a jury who found the defendant guilty and left the punishment to be assessed by the court. The court fixed the punishment by directing the defendant to pay a fine of $10 and to pay the cost of the appeal.
