Publisher Description

Opinion OF THE COURT Petitioner, Shan Gan Lee, a/k/a Shin Kan Li, seeks review of an order of the Board of Immigration Appeals, pursuant to section 106 of the Immigration and Nationality Act, 8 U.S.C. § 1105a. The petitioner challenges the Board's affirmance of an Immigration Judge's finding that he was deportable as a crewman deserter under section 241(a)(2) of the Act, 8 U.S.C. § 1251(a)(2). He claims that evidence introduced during the deportation proceedings should have been suppressed as the fruits of an illegal interrogation and arrest. I.
