The appellant, the City of Piggott, Arkansas, enacted Ordinance 209 declaring that: "* * * Pinball machines or other gaming devices are a public nuisance * * *". The ordinance further provides that it is unlawful for any business establishment or individual to possess pinball machines in any manner within the city. A violation of this ordinance is punishable by a fine of not less than $3.00 nor more than $25.00 per day.
