The National Organization for Women has instituted this action pursuant to section 296 (subd. 1, par. [d]) of the Executive Law against the Gannett Publishing Company, Inc. (Gannett), a newspaper publisher. Specifically, NOW charges that to maintain separate columns in newspaper classified advertising for male employment and female employment is violative of subdivision 6 of section 296 of the Executive Law which reads: "It shall be an unlawful discriminatory practice for any person to aid, abet, incite, compel or coerce the doing of any of the acts forbidden under this article, or to attempt to do so."
