HARWOOD, Justice. On 15 April 1963 Patricia Elaine Nicholson and Jeffrey Anita Nicholson, minor dependent children of J. D. Nicholson, deceased, who sued by their next friend and mother, Mrs. Juanita T. Nicholson, filed suit against Lockwood Engineers, Inc., Bagby Elevator and Electric Company, and Lindsey A. Dean, seeking damages for the alleged negligent death of their father, J. D. Nicholson.
