Appeal, on constitutional grounds, from a judgment of the Supreme Court (Alvin R. Ruskin, J.), entered December 2, 1987, bringing
up for review an order of the Appellate Division of the Supreme Court in the Second Judicial Department, entered January 26,
1987, which (1) affirmed an order of that Supreme Court (Morrie Slifkin, J.), granting plaintiff's motion for summary judgment
declaring unconstitutional Judiciary Law 39 insofar as it promulgated salary differentials between a Judge of the City Court
of Mount Vernon and Judges of the City Courts of Yonkers and White Plains, and (2) remitted the matter to Supreme Court for
further proceedings.
