This case is before us on appeal from the trial courts denial of appellants motion to vacate his conviction and sentence pursuant to Florida Rule of Criminal Procedure 3.850. We also have before us a petition for writ of habeas corpus. We have jurisdiction. Art. V, ? 3(b)(1), (9), Fla. Const.
