Samuel Wertheimer v. Nellie A. Byrd

Action in the Dakota County District Court wherein plaintiff sought to recover damages allegedly sustained by reason of defendant's failure to furnish marketable title to land pursuant to an earnest money agreement under which plaintiff was to purchase certain real estate from defendant. The case was tried before Robert J. Breunig, Judge, and a jury. On the basis of a special verdict, the court found for plaintiff, and defendant appealed from an order denying her alternative motion for judgment notwithstanding the verdict or for a new trial.
